The Premier League’s Key Match Incidents panel have unanimously ruled that the penalty awarded against Arsenal at Sunderland was incorrect, fully vindicating Mikel Arteta’s furious post-match reaction and confirming that referee John Brooks made an error that should never have been made.
Brooks penalised Ezri Konsa for holding Sunderland’s Dan Ballard at a corner on September 12th, with David Raya saving Enzo Le Fee’s subsequent spot-kick as Arsenal ran out 2-0 winners at the Stadium of Light. Despite the clean sheet, Arteta was furious with the decision and his post-match comments has now been backed up in full by the five-person panel.
The decision has been a talking point ever since the final whistle at the Stadium of Light. Arsenal contacted Pro Ref formally seeking an explanation in the days that followed, and the matter was subsequently referred to the KMI panel, comprising three former players and coaches alongside a Premier League representative and a Pro Ref delegate.
Their verdict, delivered unanimously, leaves no room for ambiguity. It was the wrong call, and it should not have stood.
Arteta had been unrelenting in his view from the moment the whistle was blown. His words in the aftermath were those of a manager who had seen something that defied explanation at the highest level of the game.
The panel’s verdict
The five-person panel unanimously disagreed with the on-field decision, issuing a clear statement on what they observed.
“Although it was a very untidy challenge in which Konsa initially had arms around Ballard, Ballard engages in a holding action which pulls Konsa onto him so they both fall to the floor,” the panel said.
Simply put it was a foul by Ballard on Konsa, not the other way around.
Arteta is vindicated
Arteta had described the incident in vivid terms after the match, and his account has now been confirmed as accurate by the Premier League’s own review process.
“I’ve seen it 10 times to make sure, because I watched it live, and I said ‘it’s not possible at this level that it’s going to be a penalty’,” Arteta said. “Because it’s a judo roll, that’s what it is. It cannot happen.”
He went further, “I’ve been in football for almost 27 years, 28 years, it’s not a penalty in any case, in any game, in any context, in any league.”
The VAR question divides the panel
While the penalty decision itself was unanimously condemned, the panel was split on the question of VAR’s non-intervention. Three of the five panellists determined it was “not a clear and obvious error, given the combined actions from both players”, meaning VAR was judged correct not to overturn the on-field call. Two panellists disagreed, concluding the decision should have been overturned.
It is a distinction that will frustrate Arsenal supporters. The penalty was wrong, the panel agrees unanimously. But the system designed to catch wrong decisions was deemed by a majority not to have been obligated to act. The disconnect between what is factually incorrect and what meets the threshold for VAR intervention remains one of the most pertinent issues within the modern game, and this ruling does nothing to quash stakeholders’ frustrations on the matter.
